After Gobeille, What Next For States?

This week I was interviewed for “To Your Health” on WTOP about the recent Supreme Court decision in Gobeille v. Liberty Mutual Insurance Co. While this case did not garner the same attention as previous ACA cases before the Court, the ruling may prove to be a barrier for state-level health reform efforts.


The Court ruled that under the Employee Retirement Income Security Act of 1974 (ERISA), Vermont could not compel self-insured employers and their third party administrators to provide information for the state’s all-payer claims database (APCD). Twelve states have established one of these databases and five more are in the process of doing so. What information are states collecting, why are they collecting it, and how does this decision impact efforts to improve health care and reduce health care costs? Listen to find out.
